EMCS BE: obligation e-AD arrival as of 1st April 2010!

If excise goods under duty suspension are accompanied by an electronic EMCS declaration (e-AD), , the receiving party needs to report the receipt in EMCS (EMCS arrival)as of 1st April. If you receive a paper AAD (Administrative Accompanying Document), you still have to respond on paper. As of January 1,2011 it will be obliged to send the e-AD declarations for outbound shipments (EMCS departure).

 

We recommend to check which of your trading partners will send e-AD declarations, in order to estimate if you already need to submit the report of receipt messages. We expect that the number of transactions will be limited in the beginning as there is no obligation yet to use outbound e-AD declarations.

 

The possibility to respond to the incoming e-AD's is, until further notice, only possible via EMCS Web from the Authorities. The testing of the B2G (business-to-government) communication, which is used by Porthus.net Customs, can only start from April 15 earliest.

We have asked clarification from BE Customs about the exact procedure in case economic operators receive an EMCS declaration and are not able to use the Web application yet, either because it is not available at Customs side, either because the customer has no login/password or certificates yet.

Update NCTS BE Messages IE140 & IE141

The IE140 message is sent to the declaring party within a certain timeframe after the NCTS release in case of non-clearance. The message will replace the paper TC23 letters that are currently used for this matter. The declaring party needs to respond with a IE141 message. He will only receive this message in case the Authorities have not been able to acquire the necessary information with the trader at destination.


The exact timing for the introduction of these messages still needs to be decided by Customs BE. The Authorities first need to do an upgrade of the NCTS Web application.


The processing of the IE140/IE141 messages is already foreseen in the latest version of the Porthus.net Customs application (release 4.6.1. and 3.62).

Update ICS: Import Control System

For the moment we are working on a multi-country SEAP (Single Electronic Access Point) solution for ICS to serve carriers (ocean/air/road), express operators and international freight forwarders (self-filers).
As of April 2010 we will start testing ICS with the Belgian Customs Authorities.
